6 questions to the bill on support of the domestic machine builder

At an extraordinary sitting on Tuesday, the Verkhovna Rada approved in the first reading the draft Law "On Amendments to the Law of Ukraine" On Public Procurement "(№3739 of 24.06.2020).

MPs want to ban the purchase of 88 groups of imported mechanical engineering products from Prozorro, provided they do not have localization at the level of 25-40%.

The authors argue that as a result of the bill, GDP will increase by 3.9% (this figure is given in the explanatory note to the bill, but there are no calculations).

They also expect foreign manufacturers to start building plants in Ukraine, localizing their products to maintain access to Ukrainian tenders, or to start cooperating with local producers.

The bill, which is authored by about four dozen people's deputies, is being promoted by the relevant Committee on Economic Development.

The bill has opponents: NGOs see an increase in corruption risks, the professional procurement community indicates that some items will not be possible to buy due to lack of analogues, the expert community predicts that the bill will have a negative impact on GDP (This was investigated by the KSE report from an OECD organization that has studied relevant international practice).

Some remarks were made by the Main Legal Department of the Verkhovna Rada and the Committee on European Integration. They point to the risk of restrictions by the EU for other sectors on market access to the bloc and that the project is generally contrary to Ukraine's international legal obligations, in particular the Association Agreement, Directive 2014/24 / EU, and the provisions of the WTO Agreement on State procurement ".
